Terms of Service
Welcome to Shotgun Fantasy Sports, Inc., doing business as Shotgun Fantasy Sports (“Shotgun Fantasy,” “we,” “us,” “our,” or the “Company”), a Delaware corporation. These Terms of Service (“Terms”) govern your access to and use of our website at shotgunfantasysports.com (the “Site”), our mobile application for iOS and Android (the “App”), and the skill-based fantasy sports contests and related services we offer through them (together, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
Eligibility
To use the Services, you must:
Be at least 18 years old, or the age of majority in your jurisdiction if higher, as verified during account creation;
Be physically located and reside in a jurisdiction where our skill-based fantasy contests are permitted (see Section 2);
Create only one Account and provide accurate, truthful information, including your real name, date of birth, and identification details. Each individual may hold only one (1) Account, and each household, residential address, IP address, device, and payment instrument may be associated with only one (1) Account, except as we expressly permit in writing; and
Not be a professional or amateur athlete, sports agent, team employee, coach, referee, official, or any other person able to influence the outcome of a real-world sporting event used in our contests, and not be an employee, contractor, or immediate family member of any of the foregoing or of Shotgun Fantasy where prohibited.
We may verify your identity, age, and location, including through Plaid’s identity-verification (KYC) services, and may suspend or terminate your Account if you do not meet these requirements.
Geographic Restrictions
The Services are offered only in jurisdictions where skill-based fantasy contests are legally permitted. The current list of eligible jurisdictions is available on the Site and may change as laws change or as we add or remove jurisdictions. We use geolocation technology provided by SOAP Payments to confirm your location and prevent access from restricted jurisdictions. You are responsible for ensuring that your use of the Services complies with the laws that apply to you. Attempting to access the Services from a restricted jurisdiction, including through a VPN, proxy, or other location-masking technology, may result in suspension or termination of your Account and forfeiture of winnings.
Account Creation and Responsibilities
To enter paid contests, you must create an Account and provide:
Your real name, date of birth, email address, mailing address, and phone number;
Government-issued identification information, which may include your driver’s license number and Social Security number (or a portion of it), for age and identity verification through Plaid; and
A unique username and a secure password.
You agree to: keep your Account credentials confidential and notify us immediately of any unauthorized use; provide accurate, current, and complete information and update it as needed; and use only one Account. You may not open, register, fund, or operate a second Account, whether in your own name or through another person (including a family member, friend, employee, agent, or other third party). Creating, controlling, funding, or directing multiple Accounts may result in immediate suspension or termination of all affected Accounts and the consequences described in Sections 4.6, 6, and 9. We are not responsible for losses arising from unauthorized access that results from your failure to secure your credentials.
Fantasy Sports Contests
4.1Contest Description
Shotgun Fantasy offers bracket-based, skill fantasy contests. You draft a fantasy team of real-world athletes and then compete through head-to-head elimination rounds decided by your team’s weekly fantasy score — the accumulated statistical performance of multiple athletes across multiple real-world sporting events. If you outscore your opponent, you advance; if you are eliminated, you may enter a new tournament. Winning outcomes reflect participants’ knowledge and skill in roster construction and player analysis, and are determined by accumulated statistics of multiple athletes across multiple games — not by the outcome of a single game, the performance of a single real-world team, or a single athlete’s performance in a single event.
4.2Contest Formats
We offer the following formats. Rosters draw from athletes across more than one real-world team, and drafting is conducted through an open, real-time draft in which participants have an equal opportunity to select players. Entry fees vary by contest and are disclosed before you confirm entry.

4.3Entry Fees, Prizes, and Platform Fee
Each contest runs at a set format size, and contests are filled to that size, so the prize pool and prize structure for a contest are fixed and determined in advance and do not change based on the number of participants. If a contest cannot be filled to its format size, it is canceled and entry fees are refunded, as described in Section 4.5, so prizes are never reduced because of a shortfall in participants. Entry fees fund the prize pool; Shotgun Fantasy retains a platform fee (“rake”) of up to 15%, and the remaining prizes are distributed to winning participants according to the prize structure disclosed for the contest before entry. The applicable entry fee and prizes are shown to you before you confirm entry. Losing entries forfeit the entry fee. Prizes are distributed as soon as reasonably practicable after a contest concludes, based on objective scoring.
4.4Contest Rules and Transparency
All contest rules, roster requirements, scoring, and deadlines are disclosed on the Site and App before entry. Scoring is based on statistical data provided by our third-party data providers, including SportsDataIO and FantasyPros. You may not construct a roster consisting solely of athletes from a single real-world team, and outcomes are determined by accumulated statistical results across multiple events.
4.5Scoring, Corrections, Cancellations, and Refunds
Official results are based on data from our third-party providers. We may correct scoring or advancement to fix data or system errors. In our reasonable discretion, and to preserve fairness and integrity, we may cancel a contest entry or contest, void entries, or issue refunds where we detect erroneous data or statistical lines before the relevant real-world event begins, or where a real-world event is postponed, canceled, rescheduled, or materially altered, where a technical error or fraud occurs, or where other integrity issues arise. In addition, if a contest does not fill to the number of participants required for its format, the contest will be canceled and the entry fee for each affected entry returned to the participant’s Account. Refunds are processed to your Account as appropriate.
Entry cancellation by participants. Once you submit an entry, it is final. You may not cancel or withdraw your own entry after submission, except where the contest is canceled, or your entry is voided or refunded, under this Section 4.5 or Section 4.6, or as required by law.
4.6Voiding of Entries and Recovery for Integrity Violations
We reserve the right, in our sole and reasonable discretion, to void any contest entry, cancel any pending payout, reverse any winnings (whether posted to your Account, withdrawn, or in transit), reverse any Promotional credit, and recover any amounts already paid out, where we determine that the entry, the Account, or any Related Account (as defined in Section 9.2) has engaged in any of the following:
Coordinated play, collusion, or hedging across two or more Accounts or Related Accounts;
Bonus or Promotion abuse, including coordinated entries designed to capture the value of a Promotion regardless of outcome, or entries that together cover all or substantially all possible outcomes of a contest or set of matchups;
Multi-accounting, identity misrepresentation, or circumvention of geographic restrictions; or
Any other violation of these Terms or applicable law.
In any such case: voided entries do not entitle you to any payout, and any payout already credited will be reversed; winnings derived from voided entries or Promotional credits are forfeited and may be deducted from your Account balance, offset against future winnings, recovered from any payment instrument on file, or pursued as a debt owed to Shotgun Fantasy; and your original cash deposit(s), net of valid entries and amounts already withdrawn, will be returned to your verified payment instrument unless prohibited by law or unless we reasonably and in good faith believe the deposit itself was fraudulent or part of a money-laundering scheme. This Section 4.6 applies in addition to, and not in place of, any other remedy available to us.
Payments and Withdrawals
Deposits are final and non-refundable once submitted, because they become immediately available for contest entry. Please confirm the deposit amount before finalizing. If you believe an error occurred, contact Support immediately; refunds are not guaranteed except for canceled contests, as provided in Sections 4.5 and 4.6, or as required by law.
Payments are processed by our third-party payment processor. SOAP Payments provides geolocation, and Plaid provides identity verification (KYC) and anti-money-laundering (AML) checks. To enter paid contests, you must provide valid payment information and complete verification. You agree to pay all applicable entry fees and to comply with our verification requirements. Withdrawals of winnings are subject to verification and may be delayed, held, or denied for security, compliance, regulatory, or integrity reasons, including pending the resolution of any investigation under Section 15. We are not responsible for fees charged by the payment processor or your financial institution.
Promotions, Bonuses, and Promotional Credits
We may, in our sole discretion, offer promotional credits, deposit matches, referral bonuses, free or discounted entries, and similar incentives (each, a “Promotion”). Each Promotion is subject to specific terms posted at the time of the offer (“Promotional Terms”), which are incorporated into these Terms by reference. If the Promotional Terms conflict with these Terms, the Promotional Terms control for that Promotion. All Promotions are also subject to the following:
Eligibility. Promotions are limited to one (1) per individual, household, residential address, IP address, device, payment instrument, and verified identity, unless the Promotional Terms state otherwise. We may decline, withhold, or revoke a Promotion from any Accounts that share material identifiers or that we determine to be Related Accounts under Section 9.2.
No combining or stacking. Promotions may not be combined or stacked, and may not be used together with coordinated play across two or more Accounts or Related Accounts.
Play-through. Promotional credits may carry a play-through or rollover requirement that must be satisfied before any credit, or any winnings derived from it, may be withdrawn. The applicable requirement will be disclosed in the Promotional Terms.
Nature of credits. Promotional credits are not cash, have no independent monetary value, are non-transferable, expire as stated in the Promotional Terms, and may be redeemed only by entering eligible contests.
Right to modify or revoke. We may modify, suspend, or terminate any Promotion at any time, and may revoke credits, void entries placed in whole or part with credits, and reverse related winnings where we determine a Promotion has been abused, these Terms or the Promotional Terms have been violated, or a Promotion was credited in error.
Bonus abuse. Without limitation, each of the following is deemed abuse of a Promotion and a material breach of these Terms: (a) controlling more than one Account to claim a Promotion more than once; (b) entering contests that, combined with entries from Related Accounts, cover all or substantially all possible outcomes to capture Promotional value (cross-account hedging or arbitrage); (c) misrepresenting identity, address, payment instrument, or relationship to other users during eligibility checks; (d) using or accepting funds from another user to satisfy a Promotion or its play-through; and (e) any other conduct intended to defeat the economics of a Promotion.
Where we determine a Promotion has been abused, we may apply any or all of the remedies in Sections 4.6 and 15 to the affected Accounts and Related Accounts. The return of any unmatched cash deposit is governed by Section 4.6.
Compliance With Federal and State Laws
Shotgun Fantasy offers skill-based fantasy contests that it believes are lawful in the jurisdictions where they are offered, based on analysis by its legal counsel. Our contests are designed so that: rosters reflect athletes from more than one real-world team; outcomes reflect the relative knowledge and skill of participants and are determined by the accumulated statistical performance of multiple athletes across multiple real-world events; no contest outcome is based solely on the score of a single real-world game, the performance of a single real-world team, or a single athlete’s performance in a single event; and all prizes are established and made known to participants in advance and do not depend on the number of participants. In jurisdictions that apply a predominant-purpose or predominant-factor test, our contests are designed to be predominantly skill-based.
Intellectual Property
All content on the Services — including text, graphics, logos, software, designs, and the bracket tournament formats and related features — is owned by or licensed to Shotgun Fantasy and is protected by copyright, trademark, patent, and other intellectual-property laws. Certain features are the subject of pending patent applications. You may not copy, modify, distribute, or create derivative works from the Services without our prior written consent, except for personal, non-commercial use as permitted by law.
User Conduct
9.1General Prohibited Conduct
You agree not to:
Use the Services for any illegal purpose or in violation of these Terms or applicable law;
Engage in fraudulent, deceptive, or manipulative activity, including manipulating contest outcomes, colluding with other users, hedging or arbitraging entries across two or more Accounts or Related Accounts, exploiting Promotions or scoring or data errors, using automated tools (such as bots, scrapers, or line-grabbers), or seeking any unfair advantage not generally available to other users;
Attempt to hack, disrupt, reverse engineer, or interfere with the Services or their security, or circumvent our geolocation, KYC, AML, anti-fraud, or anti-collusion controls;
Post or transmit harmful, offensive, defamatory, or unlawful content; or
Impersonate any person or provide false, misleading, or fabricated information during registration, KYC, AML, withdrawal verification, or any subsequent review.
9.2Coordinated Conduct, Collusion, and Related Accounts
A “Related Account” means any Account that shares one or more material identifiers with another Account, including IP address, device fingerprint, payment instrument, withdrawal destination, residential or mailing address, verified identity, beneficial owner of funds, household, social-graph linkage, or behavioral patterns indicating coordination of entries. Whether two or more Accounts are Related Accounts is determined by Shotgun Fantasy in its sole and reasonable discretion based on the totality of the evidence. You agree not to, directly or indirectly:
Act in concert with other users to enter contests in a manner intended to guarantee a return, reduce variance, or hedge or arbitrage outcomes across two or more Accounts or Related Accounts;
Submit entries that, combined with entries from other users or Related Accounts, cover all or substantially all possible outcomes of any contest or set of matchups;
Open, control, fund, or direct more than one Account, including through a household member, friend, employee, agent, or other third party;
Share, lend, sell, or transfer Account credentials or control of an Account;
Use another person’s payment instrument, identity, mailing address, device, or KYC documentation to register or fund an Account, or permit another person to do so with yours;
Coordinate athlete selections, entry timing, or entry amounts with any other user or Related Account; or
Pool funds with, accept funds from, or send funds to another user to enter contests, satisfy a Promotional play-through, or circumvent any limit in these Terms.
A violation of this Section 9.2 by any Account or Related Account is deemed a violation by all such Accounts and Related Accounts, and the remedies in Sections 4.6 and 15 may be applied to each. We are not required to prove actual communication or agreement among users; coordinated patterns of play combined with shared identifiers are sufficient.
9.3Chargebacks
If a deposit is charged back, any winnings generated from Shotgun Fantasy contests are invalidated, forfeited, and deducted from your Account balance, and the amount of the initial deposit is likewise invalidated, forfeited, and deducted. If your Account balance is negative after these deductions, you acknowledge and agree that the negative balance is a debt owed to us, due and payable immediately. We may close your Account without notice if a deposit is charged back. Violations of this Section 9 may result in Account suspension or termination, voiding of entries, reversal of Promotions, forfeiture of winnings, recovery of paid-out amounts, and referral to law enforcement or regulators as appropriate.
User-Generated Content and Community Standards
10.1Public Areas and Your Content
The Services include public and social features, such as Bracket Chat and private contests, where you can post messages and interact with other participants (“User Content”). Content you post in these areas is public: it may be visible to other users and, in some cases, to others, and is not protected by our Privacy Policy. You are responsible for the User Content you post and should not share sensitive personal information. We are not liable for any third party’s use of content you make public.
10.2Community Standards; No Tolerance for Objectionable Content
We have zero tolerance for objectionable content and abusive behavior. You agree not to post, transmit, or share User Content that is unlawful, harmful, threatening, harassing, abusive, defamatory, obscene, sexually explicit, or hateful; that promotes violence or discrimination; that infringes another person’s intellectual property, privacy, or other rights; that is fraudulent, deceptive, or intended to manipulate contests; that contains spam, malware, or unsolicited solicitations; or that is otherwise objectionable. You also agree not to harass, bully, threaten, stalk, impersonate, or abuse other users.
10.3License to Your Content
You retain ownership of your User Content. By posting User Content, you grant Shotgun Fantasy a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and moderate that content in connection with operating, providing, and promoting the Services. You represent that you have all rights necessary to post your User Content and to grant this license, and that your User Content does not violate these Terms or any law.
10.4Reporting, Moderation, and Enforcement
We may, but are not obligated to, monitor, screen, filter, or remove User Content at any time, with or without notice. You can report objectionable content or abusive users, and you can block other users, using the tools provided in the Services. When we receive a report of objectionable content or abusive behavior, we will review it and take appropriate action, which will generally include removing the violating content and suspending or removing the responsible user, typically within twenty-four (24) hours. Violations of this Section may result in removal of content, suspension or termination of your Account, and the other remedies described in Section 15.
Third-Party Services
The Services rely on third-party providers, including Plaid (identity verification/KYC and AML), SOAP Payments (geolocation), our payment processor (payment processing), and SportsDataIO and FantasyPros (sports data and content). These services are subject to their own terms and privacy policies, which you should review. We are not responsible for their practices or for any loss or damage arising from their use.
Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free access to the Services, the accuracy or completeness of contest data, statistical projections, scoring, or outcomes, or that the Services will meet your expectations or be free from errors. We are not responsible for losses due to technical issues, third-party actions, or events beyond our control (such as network failures or natural disasters). Fantasy-sports law continues to evolve, and future legal changes may affect the Services.
Limitation of Liability
To the fullest extent permitted by law, Shotgun Fantasy, its affiliates, and their respective officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or winnings, arising from your use of the Services, even if advised of the possibility of such damages. Our total liability to you will not exceed the amount you paid to us in the twelve (12) months preceding the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Shotgun Fantasy, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.
Suspension, Termination, Investigation, and Appeals
15.1Suspension and Termination
We may suspend, restrict, or terminate your access to the Services, with or without notice, for reasons including: violation of these Terms or applicable law; suspected fraud, collusion, coordinated play, hedging across Accounts, multi-accounting, or bonus abuse; operation, control, funding, or direction of one or more Related Accounts; initiation of a chargeback; failure to complete Plaid’s KYC or AML verification; or conduct that, in our reasonable judgment, poses a risk to the integrity of the Services, other users, or Shotgun Fantasy.
15.2Investigation and Holds
Where we have a good-faith basis to suspect a violation, we may immediately suspend your Account and place a hold on any pending or in-transit withdrawals while we investigate. Investigations will typically conclude within thirty (30) days of commencement, though they may take longer where complexity, third-party cooperation, regulatory inquiry, or law-enforcement coordination requires. During an investigation, we may request additional information or documentation, and your failure to respond reasonably and promptly is itself a basis for an adverse determination.
15.3Determination and Remedies
Following an investigation, we may, in our sole and reasonable discretion, close your Account, void entries, reverse Promotions, forfeit winnings, and recover amounts as set forth in Sections 4.6, 6, and 9. Where we close an Account under this Section, we will, subject to Section 4.6, return the verified cash balance (net of voided entries, reversed Promotional credits, and amounts owed to us) to your verified payment instrument.
15.4Appeals
If you wish to appeal a determination under Section 4.6, Section 6, Section 9, or this Section 15, you may submit a written appeal to [[email protected]] within fourteen (14) days of receiving notice. Your appeal must identify the determination, explain the basis for your disagreement, and include any information you want us to consider. We will review and respond within fourteen (14) days of receiving a complete appeal. Our determination on appeal is final and binding for purposes of these Terms, without prejudice to your rights under Section 16.
15.5Voluntary Termination and Survival
You may close your Account at any time by contacting us at [email protected]. Upon any termination, your right to use the Services ceases, but Sections 4.6, 6, 8, 9, 10, 12, 13, 14, 15, and 16, and any other provision that by its nature should survive, will survive.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of [governing-law state], without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or the Services will be resolved through binding individual arbitration administered by [arbitration provider, e.g., the American Arbitration Association] under its consumer arbitration rules, seated in [city, state]. You and Shotgun Fantasy waive the right to participate in a class action or class-wide arbitration. If arbitration is found unavailable or unenforceable, disputes will be resolved in the state or federal courts located in [venue], and you consent to their jurisdiction.
Changes to These Terms
We may update these Terms by posting the revised version on the Site or App with a new Effective Date. We will communicate material changes as required by law, such as by email or in-app notification. Your continued use of the Services after changes take effect constitutes your acceptance. If you do not agree to the updated Terms, you must stop using the Services.
Miscellaneous
Entire agreement. These Terms, together with the Privacy Policy and any applicable Promotional Terms, constitute the entire agreement between you and Shotgun Fantasy regarding the Services.
Severability. If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
Waiver. Our failure to enforce any right or provision is not a waiver of it.
Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control (such as natural disasters or government actions).
